These Terms and Conditions explain the rules for using the WebFolix website and purchasing or using our services. By accessing our website or engaging WebFolix for any service, you agree to these Terms and Conditions.
If you do not agree with these terms, please do not use our website or services.
1. About Our Services
WebFolix provides digital services that may include:
Website design and development
WordPress website development
Search Engine Optimization (SEO)
Google Ads management
Meta Ads management
Digital marketing services
Digital marketing consultation
Other related services agreed upon with the client
The exact scope of work, deliverables, timelines, pricing, and requirements for a project will be specified in the applicable proposal, quotation, invoice, or separate agreement.
2. Project Scope and Client Responsibilities
Before starting a project, WebFolix and the client will agree on the required services and deliverables.
The client is responsible for providing accurate information, content, images, branding materials, access credentials, approvals, and other materials reasonably required to complete the project.
Delays in providing required information, feedback, approvals, or access may affect the agreed project timeline.
Any work requested outside the agreed scope may be treated as additional work and may involve additional charges.
3. Payment Terms
Clients agree to pay the fees specified in the approved proposal, quotation, or invoice.
Unless otherwise agreed in writing:
An agreed advance payment may be required before work begins.
Advance payments are generally non-refundable once work has commenced.
Remaining balances must be paid according to the agreed payment schedule.
WebFolix may pause or suspend work if an invoice remains unpaid after its due date.
Additional work outside the agreed scope may be charged separately.
Project files, website credentials, or final deliverables may be withheld until all outstanding payments related to the project have been cleared, where applicable.
4. Cancellation and Refunds
Cancellation terms may vary depending on the service and project stage.
If a client cancels a project after work has started, fees for work already completed, third-party expenses, subscriptions, licenses, or other non-recoverable costs may remain payable.
Any refund, where applicable, will be considered based on the individual project, work completed, and agreed terms.
Specific cancellation or refund terms included in a proposal, quotation, invoice, or service agreement will take precedence for that particular project.
5. Third-Party Services and Platforms
Some services may require third-party platforms, software, hosting providers, plugins, themes, advertising platforms, domain registrars, or other external services.
These third-party services are subject to their own terms, pricing, availability, and policies.
WebFolix is not responsible for changes, outages, suspension of accounts, policy decisions, or technical issues caused by third-party platforms.
Any third-party subscription, advertising spend, hosting fee, domain fee, premium plugin, software license, or similar cost will be paid by the client unless otherwise agreed in writing.
6. SEO and Advertising Results
WebFolix will use reasonable professional efforts when providing SEO, Google Ads, Meta Ads, and other digital marketing services.
However, we do not guarantee specific rankings, traffic levels, leads, sales, conversions, revenue, or advertising results.
Search engine algorithms, advertising platforms, competition, market conditions, budgets, website quality, and other factors outside our control can affect results.
Advertising budgets paid to platforms such as Google or Meta are separate from WebFolix’s service fees unless specifically stated otherwise.
7. Intellectual Property and Ownership
Unless otherwise agreed in writing, WebFolix retains ownership of its pre-existing materials, templates, processes, systems, tools, methodologies, and reusable resources.
After the client has made full payment for the applicable project, ownership of the final custom deliverables specifically created for that client will be transferred to the client, subject to any third-party licenses or restrictions.
Third-party themes, plugins, stock images, fonts, software, templates, or other licensed materials remain subject to their respective license terms.
WebFolix may retain the right to use general knowledge, techniques, skills, and non-confidential development methods gained during a project.
8. Client Content and Materials
The client is responsible for ensuring that any text, images, logos, videos, documents, trademarks, or other materials supplied to WebFolix are legally owned by the client or that the client has permission to use them.
The client agrees not to provide content that infringes the intellectual property, privacy, or other legal rights of third parties.
WebFolix is not responsible for legal claims arising from materials supplied by the client.
9. Website Maintenance and Support
Unless specifically included in the agreed package or service agreement, ongoing website maintenance, updates, security monitoring, hosting, backups, technical support, and content changes are not automatically included after project completion.
Any ongoing support or maintenance services will be subject to the applicable service plan or separate agreement.
10. Limitation of Liability
WebFolix will provide its services with reasonable care and professional skill.
To the maximum extent permitted by applicable law, WebFolix will not be responsible for indirect, incidental, special, consequential, or loss-of-profit damages arising from the use of our website or services.
WebFolix will also not be responsible for losses caused by circumstances outside our reasonable control, including third-party platform failures, hosting problems, cyber incidents, algorithm changes, advertising account restrictions, or other external technical issues.
Nothing in these Terms is intended to exclude or limit any liability that cannot legally be excluded or limited under applicable law.
11. Website Use
You agree not to use the WebFolix website for any unlawful, fraudulent, abusive, or unauthorized purpose.
You must not attempt to interfere with the website, gain unauthorized access to systems, distribute malicious software, or engage in activities that could damage the website or its users.
12. Confidentiality
Where a client provides confidential business or project information to WebFolix, we will take reasonable steps to keep such information confidential and use it only for legitimate business or project-related purposes, except where disclosure is required by law or authorized by the client.
13. Changes to Services or Terms
WebFolix may update its services, website content, pricing, or these Terms and Conditions from time to time.
Updated terms will be published on this page with a revised “Last Updated” date.
For existing projects, the terms agreed in the applicable proposal, quotation, invoice, or service agreement will continue to apply unless otherwise agreed by both parties.
14. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and interpreted in accordance with the applicable laws of the United Arab Emirates.
Subject to any mandatory legal requirements, disputes arising from these Terms or our services shall be subject to the jurisdiction of the competent courts in Dubai, UAE.
